Definitions

1. In these Terms, the following words have the following meanings:

a. Assistance Animal means an animal accredited under the Guide, Hearing and Assistance Dogs Act 2009 (Qld), or otherwise recognised as an assistance animal under the Disability Discrimination Act 1992 (Cth);

b. Event Dates means Friday 25 September 2026 to Saturday 10 October 2026.

c. Event means Botanic By Night: NightGlow to be held at the Venue during the Event Dates.;

d. Session means a ticketed timeslot for entry to the Event;

e. Ticket means a valid ticket Issued by or on behalf of the Event Organiser for entry to the Event

f. Venue means Brisbane Botanic Gardens Mt Coot-tha; and

g. Venue Conditions of Entry means the standing conditions of entry and use applicable to Brisbane Botanic Gardens Mt Coot-tha generally (as distinct from these Terms, which apply specifically to the Event), as published and updated from time to time on Brisbane City Council’s website.

2. These Terms set out all information regarding attendance at Botanic By Night: NightGlow located at Brisbane Botanic Gardens Mt Coot-tha and we encourage you to read them carefully.

3. The organiser of this Botanic by Night: NightGlow is City Parkland Services Pty Ltd ABN 72 068 043 318, whose principal office is located at Level 17, 300 Queen Street, Brisbane City, QLD, 4000 (Event Organiser).

4. By purchasing a Ticket or attending the Event, you agree to these Terms.

Event Details

5. The Event will be held at the Venue with sessions daily during the Event Dates from 6:30pm to 10pm.

6. You are required to purchase a Ticket to gain entry to the Event. Your ticket(s) permits single entry to the Event for the allocated timeslot on the Event Date shown on your Ticket.

7. Tickets for the Event are non-transferrable and non-refundable. Tickets are sold subject to availability and based on Venue capacity. Tickets are only available for purchase via Oztix.

8. By purchasing a Ticket to the Event, you agree to be bound by the terms and conditions of the Event Organiser’s ticketing supplier.

9. Admission to the Event is open to all persons. Children under 12 years of age must be accompanied and supervised by a parent or guardian at all times while attending the Event.

Entry Conditions

10. The Event Organiser reserves the right to refuse entry to the Event to any person who is unable to present a valid Ticket for the Event.

11. You are welcome to bring your own food and non-alcoholic beverages to the Venue.

12. We welcome all Assistance Animals, but please note we cannot accommodate any other animals at the Event.

13. Food and beverage vendors will be present at the Event. The purchase from these vendors will be at your own expense. Please be aware that food vendors may prepare products containing common allergens including nuts, dairy, gluten, eggs and seafood. The Event Organiser does not guarantee an allergen-free environment. Ticketholders should exercise their own caution in the consumption of food and beverages.

14. To help create a safe and enjoyable environment for everyone:

a. alcohol is not permitted to be brought into the Event;

b. smoking and vaping are not permitted within the Venue or within 5 metres of any Venue entrance;

c. To help ensure a safe and enjoyable experience for all attendees, the Event Organiser may inspect bags and other items brought into the Venue and may refuse entry to, or direct a person to leave, the Event where reasonably necessary for safety, security or operational reasons, including where a person:

i. is intoxicated or disorderly;

ii. Engages in offensive, disruptive or unsafe behaviour;

iii. Possesses a prohibited item; or

iv. Fails to comply with these Terms or reasonable directions from Event staff.

d. For the safety and comfort of all attendees, the following items are not permitted unless authorised by the Event Organiser: weapons of any kind, fireworks, flares, explosives, glass bottles or containers, laser pointers, drones and other remotely piloted aircraft, generators, unauthorised gazebos, marquees or structures, camping equipment, bicycles, scooters and skateboards within event areas (excluding mobility aids), BBQs, open flames, commercial promotional materials intended for unauthorised distribution, and any other item that may pose a risk to the safety, comfort or enjoyment of attendees.

e. Attendees must comply with all reasonable directions given by Event staff, security personnel and emergency services personnel.

15. Photography and filming may take place during the Event. By attending the Event, attendees acknowledge that they may be photographed, filmed or otherwise recorded by the Event Organiser and consent to the use of those images and recordings for promotional, marketing and related purposes. The Event Organiser will retain ownership of all photographs, video and other material it creates in connection with the Event. By attending the Event, attendees consent to the use of their image, likeness or voice in photographs, recordings and other material produced by the Event Organiser for promotional, marketing and related purposes. Where an attendee is under 18 years of age, a parent or guardian accompanying or supervising the attendee is taken to have provided this consent on the attendee’s behalf. We understand that not everyone wishes to be photographed. If you or your child would prefer not to appear in Event photography or filming, please speak with an Event staff member on arrival and we will make reasonable efforts to accommodate your request.

16. Entry to the Venue is also subject to the Use of Council Parks: Community Guidelinefor the Brisbane Botanic Gardens Mt Coot-tha. Where there is any inconsistency between the Conditions of Entry and these Terms, these Terms shall prevail.

Refund Policy

17. Tickets are non-refundable except where required by law.

18. If the Event Organiser cancels a session of the Event, ticket holders may be entitled to a refund of the ticket price paid for that session (including booking fees and transaction charges).

19. Subject to the clause below, and to the maximum extent permitted by law (including the Australian Consumer Law), the Event Organiser is not liable for any loss, expense or claim arising from the cancellation, postponement or interruption of the Event or any session of the Event.

Ticket Resale

20. Tickets must not be resold without the prior written consent of the Event Organiser. Where resale has been authorised, tickets must not be sold or offered for sale at a price higher than the original ticket price, including via online auction platforms or unauthorised ticket resale websites.

No Liability of the Event Organiser

21. Attendees enter the Venue and attend the Event at their own risk.

22. To the extent permitted by law, the Event Organiser is not responsible for lost, stolen or damaged personal property brought to the event.

23. Nothing in these Terms excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law or any other law that cannot be excluded.

24. Nothing in these Conditions of Entry excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other law that cannot be excluded, restricted or modified.

Events Beyond Our Control

25. The Event Organiser may cancel, postpone, reschedule, modify, suspend or interrupt the Event or any Event session where reasonably necessary due to circumstances beyond its reasonable control, including for safety, operational or environmental reasons.

26. Circumstances beyond the Event Organiser’s reasonable control may include severe weather, natural disasters, acts of terrorism, civil unrest, industrial action, public health emergencies, power outages, government directions or other events that make it unsafe, impractical or unreasonable for the Event to proceed as planned.

Weather

27. The Event is an outdoor event and will generally proceed in wet weather unless the Event Organiser determines that conditions are unsafe or unsuitable.

Accessibility and Child Safety

28. Attendees requiring accessibility assistance are encouraged to contact the Event Organiser before attending the Event

29. Parents and guardians remain responsible for children attending the Event. Any lost child should be reported immediately to an Event staff member.

Event updates or cancellation

30. The Event Organiser reserves the right to amend these Terms from time to time and to amend, reschedule or cancel the Event where reasonably necessary. Any updates will be published on the Event website and social media channels. Any refunds or remedies available to ticket holders will be provided in accordance with these Terms and applicable laws.
